A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without legal authority.

"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.

The situation originates in a mistaken deportation to El Salvador in March, which the government later admitted was an error. After his return to the United States to answer human smuggling charges, he was held in immigration detention.

In her order, the court noted that the authorities does not have a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The court proceedings involve disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also entered a not guilty plea to the smuggling counts, which are part of a ongoing criminal case in Tennessee.
